Preamble


Palmyreparis.com is operated by Palmyre DEBRAY, 24 rue Rodier 75009 Paris – France.

These terms and conditions govern all orders and transactions entered into from palmyreparis.com and necessarily imply their acceptance without reservation by the person responsible for the order, a natural person who is not a trader, hereinafter referred to as the Customer, and who acknowledges having read the information beforehand.

Mrs DEBRAY reserves the right at any time to modify the General Conditions of Sale (GTC), the applicable version being the one present on palmyreparis.com at the time of the order.

Article 1 – Client

  1. Only persons who are legally able to enter into contracts for products sold on palmyreparis.com may place an order on the site.

  2. The Customer declares that he has read and understood the General Terms and Conditions of Sale before confirming his purchase by checking the box provided for this purpose, which constitutes an irrevocable acceptance which cannot be called into question, except in the cases limited to the paragraph "right of withdrawal".

  3. Palmyre DEBRAY reserves the right to cancel or refuse any order from a Client for which a dispute, in particular an ongoing or previous payment dispute, exists or appears during the processing of an order.

  4. Palmyre DEBRAY reserves the right to suspend or close the account of a customer who contravenes the provisions of the general conditions of sale. Any person whose account has been suspended or closed will no longer be able to order on the site without the prior authorisation of Palmyre DEBRAY.

  5. Palmyre DEBRAY reserves the right to cancel any order whose IP address of the customer is domiciled in a country different from the billing and/or delivery address

  6. When registering the Client’s personal data in the "my account" section, the latter undertakes to provide all the information necessary for its identification. It must provide accurate and complete information. The information transmitted by the Customer is binding on the latter. In the event of an error in the wording of the delivery details, the seller cannot be held responsible for the impossibility of delivering the product.

  7. In the case of delivery outside the European Union, the Customer undertakes to check the possibilities of importing the products ordered on the site with regard to the country of delivery.

 

Article 2 – Products

  1. All the products presented and offered for sale on the site are accompanied by a description to which we take the utmost care to guarantee the best possible information to our Customers. However, it is possible that non-substantive errors may occur, which the client acknowledges and accepts.

  2. The information, characteristics, photographs, texts and graphics accompanying the product descriptions are not contractual and cannot therefore be the responsibility of the seller.

  3. Although the representation of products on the site is as realistic as possible, it can happen that the actual colors are slightly different from the reality depending on the browsers and screens used.

  4. Palmyre DEBRAY wishes to inform its Clients that, to the extent that its creations are in "unique model" and made from pearls for the most part handcrafted, they can sometimes show irregularities, patterns, colour differences or imperfections due to manual shaping that are considered normal. Any major defect has in principle led upstream to the setting aside of the pearl.
    The Customer buys the product as is and with full knowledge of the facts and will not be able to turn against Palmyre DEBRAY.

 

Article 3 – Availability of products

  1. Palmyre DEBRAY only undertakes to honour orders received within the limits of available stocks. In the absence of availability, it undertakes to inform the customer as soon as possible. Availability may vary on the same day depending on sales. Palmyre DEBRAY makes a permanent update on its product availability site, but cannot be held responsible if the stock indicated no longer corresponds to the actual stock at certain periods.

  2. The unavailability of a product is mentioned on the product page concerned or in the order summary.

  3. Palmyre DEBRAY cannot be held responsible for the non-performance of an order concluded, in case of product unavailability, force majeure, disruption or total or partial strike, including shipping services and means of transport and communications.

 

Article 4 – Prices

  1. The sales prices are expressed in EUROS and are understood as All Taxes Included (VAT included), excluding participation in the specific shipping costs or gift packaging.

  2. The selling prices are those in force on the date of validation of the order by the customer. Sales prices can be changed at any time by Palmyre DEBRAY.

  3. All orders, whatever their origin, are payable in EUROS.

  4. In the event of delivery outside the territory of the European Union, the customs duties and formalities relating thereto shall be borne exclusively by the Customer. It is the client’s responsibility to check with the competent authorities in his country.

  5. The transport costs will be indicated before the final validation of the order by the Customer.

  6. The prices do not take into account any promotional offers and personal discounts, indicated before the final validation of the order.

  7. Any increase or contribution, particularly environmental, was to be created or modified, both increasing and decreasing, this change may be reflected in the selling price of the products sold on the site.

  8. The prices include the French VAT applicable on the day of the order and any change in the applicable rate will be automatically reflected on the price of the products presented on the site, on the date stipulated by the implementing decree.

 

Article 5 – Order

  1. Placing an order The order process is broken down into several steps:
    - select the product(s), check the possible options, then validate your cart
    - you can only place an order if you are clearly identified on the site, either by filling in your username and strictly personal password, or by mentioning all the information requested for online registration.
    - once identified, clearly and precisely indicate the information relating to the delivery, it concerns the precise address and any accessibility restrictions (building, floor, digicode, guardian, etc.)
    - indicate the mode of delivery chosen if several services and prices are offered to you - read and accept the general conditions of sale. Cgvs can be read directly on the site or on request be sent by email. The acceptance of Gtcs by ticking the box "I accept the general terms and conditions of sale" constitutes an irrevocable acceptance which can only be called into question in the cases provided for under the paragraph "right of withdrawal" these terms and conditions of sale.     - finally, indicate the method of payment used to pay the order on the secure interface, which will formalise the sales contract binding it to Palmyre DEBRAY firmly and definitively. Any order represents acceptance of prices and description of products available for sale. Any dispute on this point will take place within the framework of a possible exchange and the guarantees mentioned below. The on-line supply of the bank card number and the final validation of the order by the Customer will serve as proof of the order and payment of sums for the products ordered. This validation represents the signature and acceptance of all operations performed on palmyreparis.com
     

  2. Order validation
    An email is automatically sent to the Customer to confirm the order, provided that the email address you indicated in the form has been correctly filled in.
    Palmyre DEBRAY cannot be held responsible for any errors in the information provided by the Customer and for the consequences in terms of delay or delivery error. In this context, any costs incurred for the redirection would be borne by the Customer.

  3. Order Tracking
    The Customer can monitor the status of their order at any time by consulting the "my account" section on palmyreparis.com

 

Article 6 – Payment

  1. Method of payment Full payment must be made when ordering online. At no time can the sums paid be considered as advance payments.
    The Customer can pay his order online by credit card: Visa, Visa, Eurocard-Mastercard. The Customer can also access Paypal secure payment solutions, only available for delivery in France and Monaco. By choosing these payment methods, the Customer will be automatically directed to his Paypal account. Once the payment has been validated, the Customer will be able to finish his order on palmyreparis.com The bank card number and its validity date are communicated in encrypted mode to our bank (Crédit Agricole) or Paypal, which are the sole custodians of this information.
    The Customer guarantees that it has the necessary authorizations to use the method of payment it has chosen to pay its order, when validating the purchase order.
    The order amount is debited to the customer’s account at the time of payment validation.
    Palmyre DEBRAY reserves the right to suspend or cancel any execution of an order and/or delivery, whatever its nature and its level of performance in the event of refusal of authorization of payment by officially accredited bodies or in the event of non-payment or partial payment. Palmyre DEBRAY reserves the right to refuse to honour an order or to make a delivery in the event of a payment dispute in the course of administration or non-payment of a previous order issued by the Customer.
    As part of an order verification procedure, Palmyre DEBRAY may ask the Customer to send a photocopy of a piece of identification and proof of address by e-mail or postal mail, to ensure that no person steals the Customer’s identity and bank details without the Customer’s knowledge. The order will then be validated only upon receipt and verification of the requested parts. Failing receipt of such documents within 10 days of placing an order, it shall be deemed to have been cancelled by operation of law.
    The data recorded and stored by Palmyre DEBRAY are proof of the order and all transactions. The data recorded by the payment provider is the proof of the financial transaction.
     

  2. Invoice
    The customer has the original invoice in the "my account" section. The invoice is not attached to the package. The purchase order made online or the order confirmation sent by e-mail shall not serve as an invoice.
    Palmyre DEBRAY keeps an electronic copy of each invoice.

 

  1. Transfer of ownership
    Palmyre DEBRAY retains full ownership of the products sold until the full price is fully collected, including fees, taxes and mandatory contributions

 

Article 7 – Delivery

  1. Delivery areas
    Palmyre DEBRAY delivers in Metropolitan France, Corsica and Monaco, but also throughout Europe and in some countries of the rest of the world (customs and tax charges remain at the expense of the final Customer upon delivery). You can contact the Palmyra DEBRAY for information on delivery conditions in a specific country in the world.

  2. Delivery Terms
    The products are delivered to the address indicated by the customer on the purchase order. The customer must verify the completeness and compliance of the information provided to Palmyre DEBRAY cannot be held responsible for any errors of entry and consequences in terms of delay or delivery error. Under these conditions, all costs incurred for the redirection of the order will be entirely borne by the Customer.
    Delivery cannot be made to a hotel or a post office box.
    Palmyre DEBRAY cannot be held responsible for late delivery in the event of errors or disruptions due to the carriers (including, in particular, in the event of a total or partial strike, in particular by postal services and means of transport and/or communications).

  3. Receipt of the package and Customer responsibilities
    The Customer must check the condition of the package before the carrier upon receipt and notify any anomaly (damage, damaged package, missing product in relation to his order, open product, etc.). In the absence of reservations, the parcel is deemed to be accepted by the Customer and may not be the subject of any dispute concerning its delivery.
    The Customer must notify the carrier of the complaints by AR registered mail (within 2 working days of the delivery date). He shall at the same time send Palmyre DEBRAY a copy of this letter by e-mail. Any claim received outside the deadline will be rejected.

  4. Shipping times
    Orders placed on palmyreparis.com are picked up every day from Monday to Friday, except on public holidays. We strive to process all orders within 48 hours, excluding weekends and holidays.
    As soon as you have received a confirmation email you can take into account the delays of the carriers announced below.

  5. Delivery times The delivery times depend on the mode of transport chosen by the Customer and the place of delivery. We will give you an indication of the deadlines announced by the carriers.
    No reimbursement of postage costs will be made for a longer period than indicated. In addition, the Customers are informed that delivery times do not include Saturdays, Sundays and public holidays.

 

Delivery to Metropolitan France

 

“Colissimo” service: 2 to 4 days (from the delivery of the parcel to the Post Office)

 

Delivery outside metropolitan France

 

 

For delivery outside metropolitan France, we choose the most advantageous means of transport for our Customers: colissimo International, Chronopost, DHL, etc. Delivery times vary depending on the destination country and the weight of the package.

 

For a delivery in Europe, the delays observed vary from 2 to 8 days depending on the country of destination.

 

The indicated delivery times are not guaranteed during certain periods of high activity such as sales or holidays at the end of the year.

 

Article 8 – Right of withdrawal and returns

  1. Withdrawal
    For all products purchased on palmyreparis.com, the Customer has a withdrawal period of 14 days from receipt of the product. The exercise of the right of withdrawal leads to the reimbursement without charge of the sums paid by the buyer as soon as possible and at the latest within 30 working days of receipt of the products. The only costs that can be charged to the Customer due to the exercise of its right of withdrawal are the direct costs of return of goods.
    Professionals do not have this right of withdrawal.

  2. Returns
    Products must be returned intact, complete, packaged in original packaging, in perfect condition for immediate resale. They must not have been used, nor have they undergone any deterioration as minor as it is and must be in a state of perfect cleanliness.
    Any product that is damaged, incomplete, or the original packaging is damaged will not be refunded or exchanged.
    The return request is made by contacting Palmyre DEBRAY via the contact form or by email.
    We suggest you to make the return of the products in Colissimo with a recommendation or additional insurance of the market value of the products, guaranteeing, if necessary, the compensation of the products to the extent of their actual market value, in the event of dispossession or loss of goods. In all cases the return is at the Customer’s risk. It is the Customer’s responsibility to keep all proof of return.

 

Article 9 – Repayment terms


​In the event of the exercise of the right of withdrawal, the customer may request the reimbursement of the sums paid.

After return of the products, if all the conditions set out in paragraph 8 are complied with, Palmyre DEBRAY will send the Customer by email the confirmation of the acceptance of the returned products.

The refund will be made according to the same method of payment chosen by the Customer at the time of his order (provided that the means of payment used are still valid and active at the date of the refund) or by the delivery of a voucher valid for 6 months if the customer wishes.

Payment will be made within a maximum of 30 working days from the date on which the Client announced the exercise of his right of withdrawal in Palmyre DEBRAY.

Article 10 – Guarantees and Liabilities



Palmyre DEBRAY has, for all the steps of access to the site palmyreparis.com, from the order process to the shipment of the parcel or services, only an obligation of means. Palmyre DEBRAY cannot be held liable for any inconvenience or damage inherent in the use of the internet network, in particular a breakdown of service, an external intrusion or the presence of computer viruses, or any other fact qualified as force majeure, in accordance with law and jurisprudence.

The products offered by Palmyre DEBRAY comply with the French legislation in force and the standards applicable in France. Palmyre DEBRAY cannot be held liable for failure to comply with the legislation of the country where the product is delivered.

In addition, Palmyre DEBRAY will not be liable for any indirect damages that may arise as a result of the purchase of the products.

 

Article 11 – Force majeure

Neither party will have failed to fulfil its contractual obligations to the extent that their performance will be delayed, hindered or prevented by a fortuitous event or force majeure.

If a force majeure occurs, the party concerned must inform the other party within 14 (fourteen) calendar days of the occurrence of this event by registered letter with Acknowledgement of Receipt.

The two parties will then approach, within one month, unless impossible due to the case of force majeure, to examine the impact of the event and agree on the conditions under which the performance of the contract will be continued.

Expressly, in addition to those customarily established by the jurisprudence of the French courts and tribunals, total or partial strikes are considered as cases of force majeure or fortuitous cases, lockout, riots, boycotts or other industrial actions or commercial disputes civil unrest, insurrection, war, inclement weather, blocking of means of transport or supply for any reason whatsoever, earthquakes, fires, storms, flooding, water damage, government or legal restrictions, legal or regulatory changes to marketing, computer failure, telecommunication blockage, including wired or microwave telecommunications networks, and any other case beyond the control of the parties preventing the normal performance of the contractual relationship.

All obligations of the parties shall be suspended for the duration of the force majeure event, without compensation.

If the force majeure event is prolonged for more than 3 (three) months, the contract concerned may be terminated as of right without compensation by either party.

Article 12 – Personal data

For the proper execution of the order, the personal data will be processed electronically. The Customer acknowledges having knowledge of it.

In accordance with the provisions of Law 78-17 of 6 January 1978 relating to data processing, files and freedoms, the Customer has a right of access to the information concerning him stored in the files of Palmyre DEBRAY and have it corrected if necessary. All requests should be made by writing to palmyreparis@gmail.com, specifying the purpose of the request or by mail to 24 rue Rodier 75009 Paris.

Palmyre DEBRAY undertakes to use the Clients' confidential information only in connection with the operation of its site.

 

Article 13 – Intellectual properties

All data on palmyreparis.com is protected by copyright, trademark and other intellectual property rights. In this respect, all or part of this data must not be reproduced, copied, sold or exploited for commercial reasons without the express written permission of Palmyre DEBRAY. Thus, and in accordance with the provisions of the Intellectual Property Code, only use for private use is permitted, subject to different or even more restrictive provisions of the Intellectual Property Code.

All reproduction in whole or in part is strictly prohibited and constitutes infringement, unless Palmyre DEBRAY has given its prior consent.

All use by press companies, websites, blogs, etc. content from palmyreparis.com must mention palmyreparis.com or notify the photographer’s name when it is mentioned.

Any creation of a hyperlink from a website to palmyreparis.com will require prior approval and will be withdrawn upon request by Palmyre DEBRAY.

 

Article 14 –Full Terms and Conditions of Sale

A change in legislation, regulation or a court decision rendering one or more clauses of these Gtcs null and void shall not affect the validity of these Gtcs. Such a change or finding could in no case allow the Client to not comply with these Gtcs.

 

Article 15 – Duration and application


​These Terms and Conditions apply throughout the period of posting of the services offered by Palmyre DEBRAY, which reserves the right to adapt and/or modify them at any time. However, in the event of changes, the Gtcs applicable to the order placed by the Customer on palmyreparis.com are those accepted by the Customer at the time of its order.

 

Article 16 – Applicable law

Sales of Palmyre DEBRAY products are subject to French law. Any dispute relating to the existence, interpretation, performance or breach of contract concluded between Palmyre DEBRAY and the Client, even in the event of multiple defendants, shall, in the absence of an amicable agreement, the exclusive jurisdiction of the French Courts
